Patient and Visitor Recording Policy
EXECUTIVE SUMMARY:
Dr. J. Madhani Medical Corporation is committed to protecting the privacy, confidentiality, dignity, and safetyof patients, staff, learners, and visitors.
This policy governs the creation of photographs, video recordings, audio recordings, or surveillancewithin the clinic or during the provision of healthcare services.
Patients and visitors may record portions of their healthcare interaction only when all individuals who may reasonably be captured provide express consent and when recording does not interfere with clinical care, privacy protections, or clinic operations.
The following activities are strictly prohibited:
- Covert or unauthorized recording
- Recording of other patients without their consent
- Recording of clinic staff without their consent
- Surveillance of clinic spaces
- Recording intended to harass, intimidate, or target clinic personnel
- Posting recordings to social media or public platforms without written consent
Recordings that identify individuals receiving care may constitute personal health information under the Personal Information Protection Act (PIPA) of British Columbia.
Individuals who record within the clinic are solely responsible for the custody, control, and lawful use of any recordings they create.
Persons found to be recording in violation of this policy will be asked to immediately cease recording and delete the recording if required. Failure to comply may result in removal from clinic premises and further action where appropriate.

This policy establishes the rules governing photography, audio recording, video recording, or surveillance on clinic premises or during the provision of healthcare services.
The policy supports the protection of personal and personal health information in accordance with:

- Professional and ethical obligations governing healthcare providers
- Workplace safety and harassment protections
2. Scope
This policy applies to all individuals present on the premises of Dr. J. Madhani Medical Corporation or participating in clinical services, including:
- Patients
- Visitors
- Physicians
- Medical Office Assistants
- Students and trainees
- Contractors or other individuals present within the clinic
3. Definitions
Personal Health Information
Information relating to an identifiable individual’s health status, diagnosis, or healthcare services.
Stakeholders
Individuals affiliated with Dr. J. Madhani Medical Corporation including physicians, staff, trainees, and learners.
Covert Recording
Any audio, video, or photographic recording undertaken without the knowledge and express consent of individuals who may reasonably be captured.
Surveillance
Continuous or repeated monitoring of clinic spaces, personnel, patients, or operations through photo, video, or audio devices.
4. Policy Statement
Dr. J. Madhani Medical Corporation recognizes that patients may wish to record aspects of their healthcare interactions for personal reference or personal use.
However, such recordings must be conducted in a manner that respects:
- Patient confidentiality
- Privacy rights of individuals
- Professional responsibilities of healthcare providers
- Workplace safety
- The safe delivery of care
Recording is permitted only where express consent is obtained from all individuals who may reasonably be captured in the recording and where such recording does not interfere with clinical care or clinic operations.
Dr. J. Madhani Medical Corporation reserves the right, at its sole discretion, to restrict or prohibit recording where it may compromise privacy, safety, or the delivery of healthcare services.
5. Prohibited Activities
The following activities are strictly prohibited within the clinic:
- Covert or unauthorized recording
- Recording that captures other patients without their consent
- Recording that interferes with medical care or clinic operations
- Continuous or unattended surveillance of clinic areas
- Recording of confidential discussions involving other patients
- Recording that is intended to harass, intimidate, or target clinic staff
6. Consent Requirements
Recording by patients or visitors may only occur if the following conditions are met:
- Express consent must be obtained from all individuals who may reasonably be recorded.
- Consent must be voluntary and informed.
- Any individual may decline consent without explanation.
- If consent is declined by any person present, recording must not proceed.
- Consent may be withdrawn at any time, at which point recording must immediately stop.
- Clinic personnel may decline consent where recording may interfere with:

- Safe delivery of healthcare services
7. Protection of Staff and Workplace Safety
To maintain a safe and respectful workplace, no recording of clinic staff is permitted without their express consent.
Recording that targets staff members for purposes of:
- harassment
- intimidation
- confrontation
- online criticism
- or other disruptive conduct is strictly prohibited.
Patients or visitors may not record staff interactions for the purpose of publishing or distributing the recording publicly, including on social media or other public forums. Dr. J. Madhani Medical Corporation reserves the right to immediately prohibit recording activities that create an unsafe or hostile environment for staff or other patients.
8. Social Media and Public Distribution of Recordings
Any recording created within Dr. J. Madhani Medical Corporation that includes identifiable individuals, clinic personnel, patients, or clinical activities must not be posted, distributed, or shared publicly without the express written consent of all identifiable individuals captured in the recording.
This includes posting recordings on:
- TikTok
- X (Twitter)
- YouTube
- Blogs
- Public websites
- Online forums
- Messaging platforms
Unauthorized public distribution of recordings may constitute a breach of privacy, confidentiality, or applicable privacy legislation , including obligations under the Personal Information Protection Act (PIPA).
Dr. J. Madhani Medical Corporation reserves the right to take appropriate action in response to unauthorized distribution, including:
- Requesting removal of posted content
- Restricting access to clinic services where appropriate
- Pursuing remedies available under applicable law
9. Privacy and Information Responsibility
Recordings that identify a patient as receiving care at Dr. J. Madhani Medical Corporation may constitute personal health information under applicable privacy legislation.
Patients or visitors who create recordings are solely responsible for:
- The custody and control of the recording
- The security of any personal or health information captured
- Compliance with applicable privacy laws
Dr. J. Madhani Medical Corporation assumes no responsibility for the storage, use, or distribution of recordings created by patients or visitors.
10. Enforcement
Where unauthorized recording is suspected or identified, clinic personnel may:
- Request that recording immediately cease
- Request that the individual produce the recording for review
- Require that the recording be securely and permanently deleted
- Asked to leave the clinic premises
- Restricted from future access to the clinic
- Subject to further action as permitted under applicable law
Where staff safety concerns arise, security personnel or law enforcement may be contacted.
11. Authority
Dr. J. Madhani Medical Corporation retains full authority to interpret, enforce, and apply this policy in order to protect patient privacy, staff safety, and the integrity of healthcare delivery.
